Terms of Service

1. About these Terms

These Terms of Service (the "Terms") form a binding agreement between you and Fours AI ("Fours", "we", "us", "our") and govern your access to and use of the Fours AI software-as-a-service platform, including all websites, applications and APIs we operate (collectively, the "Service"). By creating an account, paying a subscription, or otherwise using the Service, you agree to these Terms.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. If you accept these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Accounts

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at foursaiapp@outlook.com of any suspected unauthorised use. We may suspend or terminate accounts that we reasonably believe are compromised.

4. Subscription plans, billing and trials

  • The Service is offered as a Free plan and as paid plans, including Pro Monthly (£299/month) and Pro Annual (£3,000/year).
  • Paid plans renew automatically at the end of each billing cycle unless cancelled before the renewal date.
  • Where offered, free trials convert to a paid plan at the end of the trial period unless cancelled. We will email you before any first charge.
  • All fees are exclusive of VAT and other applicable taxes, which we will add where required.
  • Payments are processed by Stripe. By providing payment details you authorise us and Stripe to charge the applicable fees.
  • You can manage or cancel your subscription at any time from Settings; cancellations take effect at the end of the current billing period.
  • Fees already paid are non-refundable except where required by law (including the UK Consumer Contracts Regulations cooling-off period for eligible consumers).
  • Failed payments may result in suspension of paid features until resolved.

5. Acceptable use

You agree not to, and not to permit anyone else to:

  • violate any law, regulation or third-party right;
  • upload, generate or distribute content that is unlawful, defamatory, harassing, hateful, sexually explicit involving minors, or infringes intellectual property;
  • impersonate any person or misrepresent your affiliation with any person or entity;
  • attempt to gain unauthorised access to the Service, other accounts, or related infrastructure;
  • reverse engineer, decompile or attempt to extract source code of the Service except where permitted by law;
  • use the Service to build a competing product, or to train machine-learning models on outputs;
  • circumvent rate limits, quota controls or other technical measures;
  • use the Service to send unsolicited bulk communications.

6. User content

You retain ownership of content you upload to the Service ("User Content"). You grant Fours a worldwide, non-exclusive, royalty-free licence to host, process, transmit, display and create derivative works of User Content solely to provide and improve the Service. You represent that you have all rights necessary to grant this licence and to use any third-party material in your User Content.

7. AI-generated content

  • The Service uses third-party AI providers to generate marketing copy, flyers, strategies and reports ("AI Output").
  • Subject to your compliance with these Terms, Fours assigns to you all rights it has in AI Output you generate. AI Output may not be unique to you and similar outputs may be generated for other users.
  • You are solely responsible for reviewing AI Output and confirming it is accurate, lawful, non-infringing and suitable for your use. AI Output is provided "as is" and may contain errors, omissions or hallucinations.
  • You must not represent AI Output as human-created where deception would be material, and must comply with applicable AI-disclosure laws (e.g. the EU AI Act where it applies to you).

8. Third-party integrations

The Service can connect to third-party platforms (including Meta Instagram / Facebook, YouTube, ticketing providers, email providers and Stripe). Your use of those services is subject to their own terms. We are not responsible for the availability, accuracy or content of third-party services. Disconnecting or losing access to a third-party service may degrade Fours features that depend on it.

9. Intellectual property

Fours and its licensors own all rights in the Service, including software, designs, branding and documentation. Except for the limited licence to use the Service granted by these Terms, no rights are transferred to you.

10. Confidentiality

Information that is marked confidential or that a reasonable person would understand to be confidential ("Confidential Information") must be kept confidential and used only to perform under these Terms.

11. Suspension and termination

We may suspend or terminate your access immediately if you breach these Terms, if your account is used to violate law or third-party rights, if you fail to pay, or if continued provision is unsafe or impractical. You may stop using the Service at any time. Upon termination, your right to access the Service ends and we may delete your data subject to the retention periods in our Privacy Policy.

12. Warranty disclaimer

Except as expressly stated in these Terms, the Service and all AI Output are provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, error-free or secure.

13. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot be excluded by law (including liability for death or personal injury caused by negligence, or for fraud).

Subject to the above, to the maximum extent permitted by law Fours and its affiliates will not be liable for: (a) any indirect, incidental, consequential or special damages; (b) loss of profits, revenue, business, goodwill or anticipated savings; (c) loss or corruption of data; or (d) any damages arising from AI Output, third-party platforms or content uploaded by you.

Our total aggregate liability arising out of or in connection with these Terms or the Service in any 12-month period will not exceed the greater of (i) the amount you paid us for the Service in that period and (ii) £100.

14. Indemnity

You will indemnify and hold harmless Fours and its affiliates from and against any claim, demand, liability or expense (including reasonable legal fees) arising from your User Content, your use of AI Output, or your breach of these Terms or any law.

15. Changes to the Service or Terms

We may modify the Service and these Terms from time to time. Material changes will be notified by email or in-product banner at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

16. Referral Programme

Fours operates a Referral Programme that lets existing users earn rewards for introducing new paying customers. Participation is governed by our Referral Programme Terms, which form part of these Terms. In summary:

  • A referral only qualifies once the referred customer signs up with a valid Fours referral link or code, purchases a qualifying Pro subscription, and successfully completes two consecutive monthly Pro payments (or the equivalent qualifying period for an annual plan).
  • Rewards are not payable if the initial or qualifying payments are refunded, disputed, reversed, or charged back, or if the subscription is cancelled before qualification.
  • Fours may withhold, delay, revoke or refuse rewards, and suspend or terminate accounts, where it reasonably believes referral activity is fraudulent, abusive or intended to circumvent the Referral Programme (including self-referrals, duplicate accounts, shared payment methods, or artificial sign-ups).
  • Rewards are not guaranteed on sign-up and become payable only after Fours has completed its verification checks.
  • Fours may modify, suspend, replace or terminate the Referral Programme (including reward values, eligibility and qualifying conditions) at any time, provided such changes do not affect rewards already validly earned under the applicable terms.
  • All eligibility decisions in relation to referral qualification, fraud prevention and reward issuance are made by Fours, subject to applicable law and the published Referral Programme Terms.

17. Data protection

Our processing of personal data is described in our Privacy Policy, which forms part of these Terms.

18. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. You and Fours irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

19. Miscellaneous

  • These Terms (together with the Privacy Policy) are the entire agreement between you and Fours.
  • If any provision is held unenforceable, the remaining provisions remain in full force.
  • Our failure to enforce any right is not a waiver of that right.
  • You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition or sale of assets.
